AN ORDINANCE ENACTING AN AMENDMENT TO THE CODE OF ORDINANCES TO ASSESS A TECHNOLOGY SURCHARGE FOR VIOLATIONS OF CERTAIN PROVISIONS OF THE CODE OF ORDINANCES, TO PROVIDE FOR UTILIZATION OF THE SURCHARGE AND FOR OTHER PURPOSES

 

WHEREAS, the City of Lavonia has leased certain computer software from the Georgia Municipal Association for use by the Lavonia Police Department; and,

 

WHEREAS, certain costs incurred by the City of Lavonia and the Lavonia Police Department in utilizing the computer software should be borne by violators of the City of Lavonia’s ordinances,

 

The Council of the City of Lavonia hereby ordains:

 

I.              Section 2.24.020 of the Code of Ordinances of the City of Lavonia is amended to add the

                following language:

 

                In addition a municipal court technology surcharge in the amount of $16.00 per offense for

                all municipal offenses except seatbelt violations, child restraint violations, and child safety

                violations shall be imposed by the Municpal Court.  This surcharge shall be utilized exclusively

                for the operation of the Municipal Court and/or the City of Lavonia Police Department.

 

II.            SHOULD ANY SECTION OR PROVISION OF THIS ORDINANCE BE DECLARED BY A

                COURT OF COMPETENT JURISDICTION TO BE UNCONSTITUTIONAL OR INVALID

                SUCH DECLARATION SHALL NOT AFFECT THE VALIDITY OF THE ORDINANCE AS A

                WHOLE OR ANY PART THEREOF OTHER THAN THE PART SO DECLARED TO BE

                UNCONSTITUTIONAL OR INVALID.  ALL RESOLUTIONS AND ORDINANCES AND

                PARTS OF RESOLUTIONS AND ORDINANCES IN CONFLICT WITH THE PROVISIONS

                OF THIS ORDINANCE ARE HEREBY REPEALED.

 

III.           This ordinance will become effective upon adoption by the city council as provide by the Charter

                of the City of Lavonia.

 

It is so ordained and approved by vote of the City Council of the City of Lavonia this ___5th______ day of __April________, 2004.
