April 5, 2004 – REGULAR MEETING

 

The regular meeting of the City of Lavonia Mayor & Council was held on the above date at 5:30 P.M. with the following members present:  Mayor Ralph Owens, Council Members:  Eddie Floyd, Don Canady, Kay McGlennen, and Jason Macomson.  Also present were:  City Attorney John Dickerson, City Manager Gary Fesperman, Police Chief Randy Shirley, Ruth Davis, Ruth Gillespie, Angel Morris, Bishop Willard Fitzpatrick, Dustin Walker, George Garriss, Randy Moore, Denise Matthews Franklin Co. Citizen, and Angela V. Greer City Clerk.

 

Mayor Owens called the meeting to order and welcomed everyone.  Bishop Willard Fitzpatrick gave the invocation, followed by the pledge to the flag.

 

Motion by Kay McGlennen, seconded by Don Canady to approve the minutes of the March 1, 2004 Regular Meeting as presented.  Motion carried.

 

Motion by Don Canady, seconded by Jason Macomson to approve the Rezoning of Mildred Royston at 12879 Jones Street from R1A to B-2, and to approve the following building permits:  Motion carried.

Motion by Eddie Floyd, seconded by Don Canady to approve the following Occupational Licenses:  Motion carried.

Motion by Kay McGlennen, seconded by Eddie Floyd to sign the proclamation to proclaim April 26, 2004 as Confederate Memorial Day, and the month of April as Confederate History Month.  Motion carried.

 

Motion by Don Canady, seconded by Jason Macomson to approve and sign resolution to revise certain sanitation rates as follows:  Motion carried.

 

6 Cu. Yard Dumpster to $95.00

8 Cu. Yard Dumpster to $95.00

4 Cu. Yard Dumpster to $67.50

 

Motion by Jason Macomson, seconded by Don Canady to purchase 1.42 acres from Larry T. Burdette for $5,500.00 for the Wastewater Expansion Project.  Motion carried.

 

Hartwell Railroad Company has requested that the crossing at Adams Street be officially closed in the interest of public safety issues.  City Attorney John Dickerson advised that a Public Hearing is required by Statute to explain to the public the Railroad’s reasoning for the requested closure.  Mayor Owens asked that a Public Hearing be scheduled for the next council meeting.

 

Motion by Don Canady, seconded by Jason Macomson to adopt an ordinance enacting an amendment to the code of ordinances to assess a technology surcharge for violations of certain provisions of the code of ordinances to provide for utilization of the surcharges and for other purposes.  Motion carried.

 

Dustin Walker approached the Mayor & Council that he would like to do an Eagle Scout project.  He would like to build 4 – 10ft benches to be put at the Lavonia Welcome Center, if the City would furnish the materials at $74.50 per bench.

 

Motion by Jason Macomson, seconded by Don Canady to approve Dustin Walker’s Eagle Scout project.  Motion carried.
