MARCH 7, 2005 – REGULAR COUNCIL MEETING:

 

The regular meeting of the City of Lavonia Mayor and Council was held on the above date at 6:12 P.M. with the following members present:  Mayor Ralph M. Owens, Council Members:  Eddie Floyd, Don Canady, Kay McGlennen, and Jason Macomson.  Also present was City Attorney - John Dickerson, City Manager – Gary Fesperman, Ruth Davis, Ruth Ann Gillespie, Harry Foster, Genny Cole, Charles Cawthon, Randy Moore, Police Chief – Randy Shirley, Tyler Matthews, Franklin Co Citizen – Denise Matthews, and City Clerk - Angela V. Greer. 

 

Mayor Owens called the meeting to order and welcomed everyone.  Tyler Matthews of the Lavonia First Baptist Church gave the invocation, followed by the pledge to the flag.

 

Motion by Don Canady, seconded by Kay McGlennen to approve the minutes of the February 7, 2005 Regular Council Meeting as presented.  Motion carried.

 

City Manager gave the Planning & Zoning Commission report as follows:

Barry Goodyear – Modular home……………………….....GA Hwy 59………...approved

Billy Hart – New Home …………………………………….Luckie St…………….denied

Lavonia Clinic -  Storage Building…………………12192 Augusta Rd…..…….approved

Lavonia Church of Christ – New Church……………GA Hwy 59… …………...approved

 

Motion by Don Canady, seconded by Eddie Floyd to approve building permit#627 for Barry & Karen Goodyear at 6699 West Ave for a modular home.  Motion carried.

 

Motion by Jason Macomson, seconded by Don Canady to denied building permit#613 for Billy Hart at 23 Luckie St for a new home construction.  Councilman Eddie Floyd opposing.  Motion carried.

 

Motion by Jason Macomson, seconded by Eddie Floyd to approve building permit#625 for Lavonia Clinic at 12192 Augusta Rd for a storage building.  Motion carried.

 

Motion by Kay McGlennen, seconded by Jason Macomson to approve building permit#626 for Lavonia Church of Christ at GA Hwy 59 for a new construction.  Motion carried under the condition that they get GA DOT approval before permits will be issued.

 

Motion by Don Canady, seconded by Eddie Floyd to approve the occupational license for Silver Lining Gifts at 100 West Main St for a variety shop.  Motion carried.

 

Motion by Don Canady seconded by Eddie Floyd to approve the occupational license for FC Risk Reduction Program of Northern Circuit, Inc. at 795 Grogan St for a risk reduction program.   Motion carried.

 

Motion by Don Canady, seconded by Kay McGlennen to appoint Anne Bielski to replace Bill Horton’ s 2 year term on the Historic Preservation Commission Board.  Motion carried.

City Attorney John Dickerson came before Mayor and Council with two annexations having a Public Hearing for a first reading for the following:

 

Bobby McMurry – 80 foot strip of land adjacent to the railroad, beginning at the property of the old waffle house and runs beyond the Old McMurry house.  City limits was at the railroad right-of-way and the railroad right-of-way has be moved so this is the purpose of this annexation.  If annexed it will be annexed as B-2 which is consistent to parcels of land fronting on Highway 17.  The Planning and Zoning Commission Board has approved this annexation and the zoning B-2.  Public Hearing on the McMurry annexation and zoning request now terminated for the first reading.

 

Motion by Eddie Floyd, seconded by Don Canady to approve of the first reading on the annexation of the property of Bobby McMurry into the city limits with the zoning classification of B-2.  Motion carried.

 

Russell and Pamela Hill  - property adjacent to the Zaxby’s on the South side of GA Hwy 17 this is the location of an Exxon Service Station to be annexed and zoned as B-2.  The Planning and Zoning Commission Board has approved this annexation into the city limits and the zoning B-2.  Public Hearing on the Hill property was adjourned for the first reading.

 

Motion by Jason Macomson, seconded by Kay McGlennen to approve of the first reading on the annexation of the property of Russell and Pamela Hill into the city limits with the zoning classification of B-2.  Motion carried.

 

Motion by Don Canady, seconded by Eddie Floyd  to approve the signing of the agreement for the Transportation Enhancement Project STP-0002-00 (317), P.I. No. 0002317, Pedestrian Improvements along Bear Creek, Adams Street, and Crest Drive, Franklin County, with Moreland-Altobelli Associates, Inc. to revise the completion date to December 31, 2006 for this project.  Motion carried.

 

Motion by Jason Macomson, seconded by Eddie Floyd to have a summary financial report for each of the funds for the Mayor and Council.  Don Canady abstaining from the vote.  Motion carried.

 

Councilman Jason Macomson inquired about the progress with the B & D Building Supply’s clean-up.  Mayor advised that the owner was cleaning area up.

 

Motion by Kay McGlennen, seconded by Jason Macomson to write a letter to the Department of Transportation to name the I-85 and Georgia Highway 17 Interchange to Ernest Vandiver Interchange.  Motion carried.

 

Motion by Don Canady, seconded by Kay McGlennen to donate $10,000.00 out of the General Fund savings to the Lavonia Cultural Center.  Motion carried.

 

Motion by Jason Macomson, seconded by Don Canady for the City of Lavonia to act as the general contractor for the Police department and Fire department projects.  This will take an additional $2,000 for each construction package to be put together. Motion carried.
